Payment – (Artistic Cake Design accepts only the following forms of payment: Cash, Check or PayPal)

Retainer (Retainers Are Non-Refundable) – For customer paying by cash or PayPal a non-refundable retainer of 50% of the total order is required to hold your event date no later than 2 days after receiving the retainer invoice. For customers desiring to pay by Check, “FULL PAYMENT” is required within 5 day of receipt of the invoice and confirmation for the event date is not guaranteed until the payment method has cleared our financial institution.

Final payments- Outstanding balances are due in full upon delivery, customer paying final balance through PayPal are required to have payment made 24hrs prior to delivery.

Changes to Orders – Any change must be submitted by email no later than 7 days prior to scheduled event date. All changes are subject to price increases and availability. There will be no changes to the design with less than 7  days from scheduled event date.

Cancellations- Cancellation requests made on orders before the event date and final payment has been made, the deposit on the order is non-refundable. On orders where full payment was received as a deposit and production has not begun, a refund of 50% of the order amount will be made to customer within 10 days of notice of cancellation by check or PayPal credit. On orders where full payment was received as a deposit and production has begun, the customer will receive a refund, less the cost of all supplies already purchased, expenses incurred, and the deposit for the date.

Refund Policy – Refunds are at the sole discretion of Artistic Cake Designs and the following scenarios are the only instances in which Artistic Cake Designs would consider a full or partial refund. Refunds are made by check or PayPal credit within 10 days of refund approval. (No Cash Refunds)

Failure by Artistic Cake Designs to deliver your dessert on the date of your original contracted event. On scheduled deliveries, if delivery is made 2hrs late or less for the agreed upon time Artistic Cake Designs will NOT provide a refund.

If at time of delivery/pick up the dessert does not meet your expectations and you do not accept the dessert, Artistic Cake Designs will refund the order amount minus a 25% handling/cancellation fee.

If you report a serious problem with flavor and/or texture immediately and the product is returned the same day of delivery/pick up or latest next day with less than a 1⁄4 of the dessert order consumed and the quality of the cake flavor or texture is determined not to meet out standards. Quality determination is solely at the discretion of Artistic Cake Designs.

Note: If Artistic Cake Design agrees to a full refund at the time of delivery/pick, you cannot keep the dessert and Artistic Cake Design will not be responsible for any additional expenses that the customer may incur as a result of not accepting the dessert and a maximum liability of the value of the dessert order in questions.

Discounts – Artistic Cake Designs takes great pride in the detail and quality if its products, for that reason Artistic Cake Design does not off any discounts. Sizes, flavors, textures and designs are subjective and Artistic Cake Designs will do

everything in their power to exceed your expectations. Please note that colors and design of the actual dessert may vary slightly from the hand drawing, computer image due to the nature of digital and edible components.

Delivery - Once a dessert has been picked up by customer and/or a designated party it is considered “Accepted”. All desserts are the responsibility of the customer once possession is taken and Refunds/Discounts due to size, decorating style, color shade or general decoration design will not be honored.

Food Allergies and Flowers Disclaimer (For customers who request the omission of a specific allergen in their dessert)

Artistic Cake Designs regularly uses soy, wheat, dairy or nuts in our ingredients and cannot be held liable for allergic reactions that occur due to trace elements of the allergen coming in contact with our desserts. Artistic Cake Designs will strive to eliminate contact with the known allergen to the best of their abilities, it is not a bakery that specializes in allergen-free desserts therefore a 100% allergen-free product cannot be guaranteed. It is the customers responsibly for informing their guests of this allergy information. Fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Due to this, Artistic Cake Designs will not place fresh flowers on our desserts.

Dark Colors Disclaimer (For dessert orders that involve dark reds, blues, purples, or black colors)

Dark food coloring on desserts has the potential to stain linens, clothing, furniture, and teeth upon contact. Artistic Cake Designs cannot be held liable for issues resulting from my choice of dark color(s). Artistic Bakery Designs will strive to accurately match color choices, however some color tones, especially deep reds, vibrant blues, and violet tones, may not make an exact match due to the natural base colors of cake, frosting and decorating ingredients. Deep colors require a significant amount of food coloring, which may adversely affect the flavor and quality of desserts.

Custom Flavor or Recipe Disclaimer (For customers who request a specific flavor, filling, or finish that is not offered on Artistic Cake Design’s menu)

Requesting that Artistic Cake Designs provide a specific flavor, filling, or finish that is not offered on the regular menu. Artistic Bakery Designs cannot be held liable for any problems resulting from this request including but not limited to structural or quality issues with the dessert. Production of the dessert, if a custom recipe or flavor request fails to perform well or risks compromising the stability or overall quality of the dessert, Artistic Cake Designs may substitute that part of the dessert with a more suitable and reliable menu option. Artistic Cake Designs will notify the customer upon delivery or pickup if/when that occurs.

The #1 goal of Artistic Cake Designs is to provide a stable, edible product therefore no refunds will be provided due to dissatisfaction with any recipe, flavoring, or formula that was not suggested by the bakery itself.

Outdoor Product Display Disclaimer (For customers who intend to display our desserts outdoors)

Understand that an outdoor environment is less suitable for desserts and may expose the desserts to insects, damage, or debris. Artistic Cake Designs cannot be held liable for damage on a dessert that is displayed outdoors since natural outdoor conditions such as heat, wind, humidity, or un-level ground can weaken or ruin the infrastructure and/or decorations on our desserts.

Liability Disclaimer

By making final payment and/or acceptance of the product upon pick up and/or delivery the customer agree to the terms, conditions and disclaimers associated to the customer’s order and release, waived.
